IRS Abuse Report #61

In 1989, my ex-husband left me. I have a son (not his). Within 6 months of his leaving, I was laid off from my job. (I also do not get child support -- his father refuses to pay.) My husband talked me into filing joint since we were still married in '89. I signed the form he worked up; it looked fine to me. Well, after he mailed it in, I found out that he had not paid ANY taxes for the year. Needless to say, we had to pay. Well, I ended up paying about three thousand dollars for him. He didn't file his taxes for at least three years, because it took me that long to pay it off. I asked the IRS why I had to pay his debt and I was told that 1) we were still married -- separation didn't count; and 2) "we take easy money, whoever we can get to pay first -- we don't care who pays." I ended up filing bankruptcy -- against my better judgement. I asked the IRS the second year why they weren't taking any money from him, too. I didn't get an answer. I asked if my ex was even filing his taxes: no answer. The second year I was paying his debt, the IRS sent me a letter saying I owed a little over $7,000. Since I had only made $9,000 that whole year, I laughed, then I got mad because they were serious. I was going through the bankruptcy, so my attorney also called the IRS to find out what was going on. She and I both fought them for a year just to get answers. We both got a different person every time we called. I got a letter about every month, and we called the IRS every week to find out what was going on.

I ran a successful contracting business for over ten years and had many employees. Due to an error in math I underpaid withholding taxes. I told the IRS this at the end of the year when I discovered the error. They fined me $40,000 and forced me into bankruptcy. Even after going bankrupt I still owe $16,000 personally and have had my accounts cleaned out and my wages garnished.

The federal income tax and the IRS is destroying the very principles this country was founded on.

Recently the IRS has adopted a new set of rules taxing tuition waivers for employees. Many university employees work for reduced salaries, like myself, because they are going to school to better themselves and the university gives them free tuition to compensate the difference.

IRS is collecting millions if not billions of dollars with this new law that is probably making many unfortunate people have to discontinue their graduate studies because they cannot afford to give the IRS several hundred dollars a month in tuition waiver tax. Please help!

I have been battling the IRS for about 10 yrs now. They have a lien on the house, and until recently had a lien on my wife's salary. Last year we managed to make a (over 10% reduction) "contribution" to our tax liability. Seven months after this activity we receive notices of "WE HAVE CHANGED YOUR ACCOUNTS" where they added over $8,000 in "late payment penalties" and over $40,000 in interest! This interest figure represented, in a 7 month period, a 31% rate!

I have other information available if I can be of assistance in your fight.

Recently I received a notice of levy from big brother of over $1500. The interesting part is that they are holding $1000 that they won't apply to this levy, and they refuse to let me make payments. They say that they won't release the cash because of the chapter 13 filed to prevent them from getting money from my trustee . It seems to me that if they are holding money that they owe me, it should be applied to the new levy, then I could afford to pay them off. This is the first notice that I have received on these new owes they say they have sent four. Any help or advice you can offer would help, what's next, be forced into homelessness?

When the IRS, allegedly, could not reach me at my N.Y. address that I had lived at for almost 8 years, they put a levy on my salary taking 90%. This left about $134 a week to live on. I lived on Long Island and used the Long Island Railroad -- that alone cost $140 monthly. Rent was $1330 and I won't even add in all the other expenses, phone, utilities, credit payments, loans, food, etc... Since I couldn't afford to work I had to resign. I had about $18,000 saved so I moved to North Carolina where the cost of living is less than N.Y. and immediately hired a tax specialist to see what they could do. After almost a year of negotiations, the IRS `AGREED' to allow me to make monthly payments of $740 to pay off my alleged underpayment of taxes since 1990 of $40,635.25. If I had $740 extra a month I'd have a nice sized savings account but as it happened I couldn't find a job for 10 months, exhausted all my savings and don't have a bank account at all.

I am to start making this payment in 2 weeks. If I make this payment I will not be able to pay all my other monthly bills. I am now shopping for a good, cheap bankruptcy lawyer. I am going to miss payments so I might as well go bankrupt before the harassing creditor calls start. How is it they could find where I worked to levy my salary but couldn't call me there or get my address from my employer?

The IRS is definitely more dangerous than most of the criminals in jail today. They don't kill you or maim you, they just rob all of us daily in the name of government, rape us, ruin us financially and make our lives a living hell.

A couple in Dayton Ohio saved for years to buy a dream home. The IRS had several properties advertised for sale at auction (seized properties). The IRS assured everyone that all the houses had clear titles.

The couple bid on a house and were high bidders. The IRS required $24,000 down payment. The couple put the $24,000 down and went to the bank for a mortgage for the balance. This wasn't a problem until they did the title search. The house had $150,000 in liens against it. The couple demanded that the IRS return their $24,000 but the IRS refused, saying the couple should have checked for liens (even though the IRS had assured them previously there were no liens).

If a real estate agency in the State of Ohio had done this, everyone involved would have been jailed. How can IRS agents get away with breaking fraud laws just because they happen to be employed by a Federal agency? This is the ultimate in sleaze.

Our trouble started in Jan.1985. We can't own anything, get credit etc... This last year they have been really bad. Garnishing wages illegally, Levies, false payment agreements. The told us to move out of our house in to a small apartment with our 2 sons. One of our sons is Attention Deficit with Hyperactivity and is under care. That is just part of the things they have done. I could write a book. The lies and deceit are unbelievable. Our legal bills are growing and our Attorney has recommended we file suit for damages and legal fees for all the hell we have gone through.

The IRS's repeated attempts to audit me in person even though I was incapacitated at the time from an automobile accident is typical of the IRS.

The time and money I am spending due to their corrupt and inhumane beaurocracy could be spent in producing productive goods and services. They are crippling our country.

I voluntarily served in the armed forces, and after my final year of service, I was not given a W-2 form by the navy. I could only file on the other income which I earned that year. For 3 years now the IRS has harrassed me, threatened me with liens and garnishings.

I have been diagnosed as Atypical Bipolar-II Rapid Cycling. In simple terms this means that I suffer from an "atypical" form of manic-depression.

Over the past 10 years, I have been hospitalized approximately 12 times in both private and state hospitals. At least three of my hospitalizations occurred during tax time (Jan 1 through April 15). When you are hospitalized, voluntarily or by judges order (I have experienced both), there is no way you can comply with the tax laws or IRS policies.

The tax laws require (mentally) disabled people to do things they cannot do. (We are not on a mental/fiscal schedule, when we're ill, we're ill.) That sort of makes the ADA and the tax laws contradictory. When a person like myself goes into remission and does file his/her return after April 15, without an approved extension, we are subject to financial penalties and interest through no fault of our own.

There IRS offers no accomodation to and for the mentally ill. The IRS has ignored the reality of our needs to help us comply with the law. They however hold us 100% accountable for their unjust penalties and interest.

Communication from the IRS is a pretty scary thing for all of us, but it can be a precipitating factor to someone like myself. I recently received a letter from the IRS advising me that they will soon place levies on my car and possibly my wages. Well I am living with that for now, but if I were in a degenerated state, it might be just enough to cause a psychotic episode resulting in anything from running to nowhere and putting myself in harms way, to hospitalization, to suicide. All over tax laws and their unfair means.

They put a lien against me for back taxes they said I owed, I did not. When I tried to prove this they told me I had to pay them in full before I could get my money back even though they agreed with me. They have damaged my credit record with this injustice. If this was the private sector of business the people involved would all be fired for malice, slander, mental anguish etc. and a lawsuit would be won hands down!

I have been nearly sequestered in my home since November 1994 due to actions of the IRS.

They stole the contents of my personal bank account in 1994 and demanded immediate payment of alleged underpayments, fines and penalties in the amount of approximately $180,000.

I have since gone through my records -- I have all records from all years. It turns out they owe me over $30,000, none of which I will ever see, and that doesn't include any interest calculations.

In the process of proving this, I have been unable to continue my business causing economic loss to not only myself, but my customers and my employees.

We have been under the thumb of the IRS for over 10 years now. Currently, we are at the end of our 45 day stay against collection action while we are scrambling to put together our offers in compromise.

I was told by one IRS phone agent that I should get a real job and finally become a responsible taxpayer. When I call seeking help to solve our long term problem, all I get are standard form letters. When I call the IRS office I get abusive, patronizing, condescending slurs to my character and my responsibilities as an American.

When I asked for names, I was most often refused the information with comments like "it was of no value to me to have their names and therefore it's unnecessary".

After going bankrupt over five years ago from my first encounter with these people, I have never dug out. Now they have added 100% in interest and penalties and the interest is still compounding -- yet no one will help us. This agency is absolutely out of control and needs to be abolished.

In 1988, I received a computer-generated IRS form letter about an over-refund from a couple of years before. The signature was a totally illegible inkblot. I called the 800 number on the letter -- every day for 6 months. No answer. I called the local IRS number. No answer.

I wrote to the IRS at the address on the letter. My response was another letter, identical to the first one, with the same inkblot signature.

Without any further warning, they began levying my salary -- 100% of it. I took home $0.00 paychecks for three and a half months. My home and car were both repossessed because I fell so far behind in my payments. The only reason I survived was through the kindness of a co-worker.
