IRS Abuse Report #188
Date: Thu Aug 28 10:25:13 1997
To: sue@irs.class-action.com
From: DG

On Friday, August 8, 1997, at approximately 8:30 a.m., as I and Russel and Richard, my neighbors two sons who were in my care, were returning to my car at the vets office at 300 S. Dixie Highway, I saw two or three police cars, and a big flat bed tow truck blocking my way out of the parking lot. One police officer (James Schott) came over to my car and asked, "How are you today?" I answered, "I"m happy and joyful". He seemed nervous, looking around at other people who were coming closer to my car. I didn't know what was going on and I thought they"re going to have to move those vehicles so that I can go home.

The officer Schott then asked me nicely to get out of the car I said "why" Before he had a chance to answer, another man (Daniel Dockum) very rudely commanded me to get out of the car. I said to him, "who are you?" he answered in a very intimidating manner, "you"ll find out, just get out of the car and tell the boys to get out too." I grabbed my purse and opened the door. I told the boys to go ahead and get out also.

Officer Schott asked "are you Denise" I said yes, then he said, "these are federal agents, do you know her?" pointing out a girl who was walking towards me, I said "yes" after recognizing her to be Revenue Officer C. Barron. Ms. Barron walked up to me and handed me a copy of Publication one. She said, "Are you prepared to pay six thousand three hundred ninety nine dollars and eleven cents". I answered "For what, I don't even have a checkbook with me". She said, "I am taking your car".

Three more people in suits came walking towards me. Some from a dark blue car and others from a gray van. I did not know these people. No one introduced themselves or showed me any identification even after I asked.

"Do you have a court order signed by a judge?" I asked. Daniel Dockum got right in my face, I could feel and smell his breath, and said, "she doesn't need a court order, here is her authority", and somebody handed me IRS Form 668-B, Levy. Turning to officer Schott, who looked confused, I said, "she can't take my car, without an order from the court signed by a judge, don't I have any rights?" Daniel Dockum shouted "NO". I said to officer Schott, "We have not been in front of a judge yet, she has no court order, are you going to let her steal my car? Officer Schott faced me. I think I saw a little compassion in his eyes, and he said, "Look I"m just a Pompano Beach police officer, these people are federal agents, you will cooperate with them and not give anybody any trouble or I will have to put you under arrest". With the boys in my care for the day I knew at that moment that it was useless to assert myself or insist on my rights. I felt like I was starting to cry. I was very angry, like I was being violated by this gang of thugs and there was no one to help me.

Because they ignore the laws of America, they have made it impossible to buy a home or raise my children. They have put a lien on me and harassed me to no end. They threaten to take everything I own. Where is the protection of American lives that we the citizens of America work for?

My father had a heart attack last year and passed away due to IRS attacks. He was also an attorney. He was a 54 year-old healthy, athletic husband and father to four daughters. The IRS still calls and harasses my mother.

I would love to be able to do something about this so others don't lose their loved ones due to IRS stress.

Thank you

I challenged the IRS several years ago over an alleged corporate tax debt of less than $30K. My argument? The corporation couldn't possibly owe money for employee wage taxes since the tax years for which the debt was assessed was when the cooperation was defunct. It had no employees to tax; therefore, it could not possibly owe any wage taxes.

The IRS refused to listen to reason and common sense. They had one mission: to collect the alleged tax regardless of whether it was legitimate or not. Why? Because I questioned the IRS's authority to act outside of the law.

My punishment was swift. The IRS seized and sold over $1/2 million of my personal property for $16K. The IRS performed no inventory since it would show the value of the seized property to be far in excess of the alleged tax debt. The IRS took over $60K in cash from my personal safe, family heirloom jewelry, savings bonds being held for my children's coin collection and personal papers. To show their arrogance, the IRS never even admitted taking the cash or other items. It just disappeared.

My wrongful levy suit was an exercise in futility. District and appellate courts denied my wrongful levy suit. The courts said I had to prove the property seized and sold was my personal property and not that of the corporation, yet the IRS allowed my records that would prove such to be lost or destroyed. Because the IRS refused to take an inventory of the property, I attempted to photograph the seized items and was threatened with arrest despite the fact no such law exists preventing me from taking pictures. The IRS was intent on burying me for questioning their authority, pure and simple.

I couldn't even sue the IRS. The US government replaces the IRS as a defendant in such matters. What this means is that the US Justice Department argues in favor of the IRS and against the taxpayer, right or wrong. It's a mismatch of biblical proportions. A pro se litigant versus the tax attorneys of the US Justice Department. You're financially devastated following a tax sale so you couldn't afford counsel IF you could find one to even take the case! You're left alone to battle the government Goliath in matters so incredibly complex even the IRS admits it does not understand the laws it is charged with administering.

In federal court, you are asking a judge to go against his employer and the US Justice Department attorneys, something only a rare few have the courage to do. Those jurists that demand IRS accountability can expect to encounter the IRS's wrath for enforcing constitutional rights of the taxpayers.

The time to end IRS arrogance is now. The IRS is not above the law, but it will continue to act this way until Congress steps in and acts to protect citizen rights. The IRS does not recognize the US Constitution, so beware if you think the law will protect you against the IRS. I tried it. I lost everything and I live in fear they lurk in the shadows waiting to attack again. And they will. As long as I demand accountability.

Keep your doors locked if the IRS comes calling. They can take what they want without a search warrant. The jurist in my case said the IRS does not have to comply with the provisions of a criminal search warrant since the case is a civil matter. I petitioned him and the appellate court with the actual federal procedural rules and case law showing IRS entry warrants MUST conform to these rules, and my pleas fell upon deaf ears. Translation? The Constitution will not protect you from the IRS. If you prove the law is on your side, both the IRS and their courts will simply look the other way. They both have tunnel vision, to collect taxes and the laws be damned!

As a sidelight, please note that even the IRS has a sense of humor. Of all the property it seized and sold, the only thing it left was some books explaining how the IRS illegally collects taxes. I guess they didn't want to publicize the fact they are at-large criminals wreaking havoc on decent, law abiding citizens. Could you blame them?

We lost our entire focus of life for ourselves and our children. We have no incentive for working towards a better life and securing our future since we are living proof that IRS can walk in and find millions of reasons to keep us in debt to the government forever. We are a family of five, 44 and 38 year old husband and wife, self employed working in excess of 60 hours per week to just keep up with our current bills and have no time to supervise our children due to work load. Psychological effect of our faulty prosecution from the IRS has caused us to make insurmountable amount of mistakes, errors and misjudgments that has been hurting everything and everybody around us including ourselves. We just feel we are only a small part of a very, very sick system.

The easiest way out would be to commit suicide and the debt would not be inherited. We have absolutely no retirement plan, no savings account, no life insurance and no hope. Our American dream was destroyed by dark forces of the IRS, the destroyer and executioner of the weak, and defenseless small business owner.

I am glad to see that someone is finally doing something about the IRS and their abuse of power.

In 1976, my mother owed $300 in taxes. They were not paid due to the fact that she was diagnosed with cancer and given 12 weeks to live. In May, as she lay dying, two IRS agents showed up at my house where we had moved my mother to take care of her. They told me they were friends and had come to visit.

I took them to her room where they introduced themselves as IRS agents and served her with papers to confiscate everything she owned. She was to weak to sign the paper but did make an X and I signed for her. On that day, they took everything she owned....even the soda bottles at her place of business! She died within the week. Glad to see someone is doing something about their abuse of power.

When I filed my tax return few years back there was a simple error (i.e., #1 was not entered in the personal exemption column, but the number of exemption claimed etc., and the final amount to be returned by the IRS were correct. But the IRS got confused by this and sent my return for audit.

After the audit and many letters/faxes to the IRS, I still had to take my case to Tax Court. I can 100% say that the people working in IRS don't really don't know what they are doing. I can provide detailed information of my experience that relates to how people are chosen for audit and what a poor job IRS does in handling even simple returns.

All I'm doing now is going in circles paying the compounding interest and penalties! The IRS seized my checking account 3 years ago and forced my son and I to move out because the rent check bounced!

There has to be some way or someone that could help put a stop to this merry-go-round we're all on. Can't they give amnesty to the interest and penalties and have us pay what we owe in TAXES? Or at least change the structure of the installment agreements to stop the compounding penalties and interest once the agreement is in effect. I owe $12,000 to them...but more than 50% is their compounding penalties! I will never in my life be able to pay them off, never be able to purchase a home. I'm sick and tired of it!

IRS agents came to my house threatened my wife with garnishment of her wages, embarrassment at her employment, taking her house and car, they filed tax liens against her on the possibility she was involved in management of my bankruptcies. I eventually proved her innocence after loosing her and my children, and they withdrew their liens against her. Their attitude: "TOO BAD SUCKER -- WE DON'T CARE IF WE WRECK YOUR LIFE."

I have been audited every year since 1977. I have put hours of work and money into each audit. But soon, the audit for the next year arrives. I have just finished fighting 94 and am currently fighting 95 and 96 -- all because I am a hard working, small business person. The auditor who keeps recalling me, admits she wants to put me out of business. I am exhausted -- though I have not lost what many have -- this harassment has been going on much too long.

1992 my So. Cal. home and home based business was heavily damaged by a drought ending rain and mud slide. The damage was inspected and I applied for, and received a $5000 SBA loan for personal effects, and a $5000 SBA loan for my business, a sole proprietorship making enough to survive on. During the next two years I started to rebuild by applying the SBA loan for its intended purpose. I was making the monthly repayment on the SBA loan. I reconstructed lost records from the mud slide and got up to date with the IRS. They immediately levied the $4000 remaining from the SBA loan. I lost two employees, could not pay any bills, and eventually had to file bankruptcy. This was in spite of the fact that I was making quarterly payments to the IRS. This was followed by an audit of my next two years returns, including threats of seizing everything. They even contacted my clients and demanded they send the IRS my accounts payable. I lost that client. I am a U.S. Army veteran and a former Peace Corps volunteer. I see no reason to try to increase my income with the IRS Gestapo using illegal shake downs, thugs, and criminals.

The issue still under scrutiny is the security deposit issue. I have a tape of an IRS representative stating that my position is correct and I have sited the IRS publication in support of my position and they will still not let the matter rest. I have been told twice by 2 different IRS people associated with my file that it does not matter what we say OR what our own publication states, it is a court that decides the rules!! This to me is incredulous! I have relied on professional advice, IRS publications and the IRS itself for my position and this is not enough. I am continued to be harassed.

Just last week, in this continuing nightmare, I received a form letter from the IRS wanting documentation on some mortgage interest deductions that supposedly do not match up with their records. I have talked to several tax professionals who have told me that I have for some reason made somebody at the IRS mad and that this is not good. I have been told "Do not underestimate them they are a VERY powerful organization."

I also have had CPA's refused to represent me as they are afraid for themselves. I am a law biding tax paying middle income citizen that has not cheated on my taxes. We need to stop this abuse. This is chillingly similar to the days of J. Edgar Hoover.

I too am a victim of the vicious IRS. In 1987, I worked for several temp agencies, during tax filing, I mistakenly forgot to add one of the W2 forms (1 out of 6 of them). I was notified by IRS in 1990 that since I did not add this with my 87 filing I would be penalized. The taxes on the W2 was $225. After my numerous calls and letter writings, the IRS in 1993 decided to contact my new employer and put a lien on my salary. I have been paying the IRS $150.00 a month for the past 3 years. Plus, they have been taking any refunds that I should have gotten from IRS. I was told at the time that it would take only 3 years to repay the $6,000. But I have now come to find out that I have been penalized with interest and penalties. Well in the past 3 years I have paid almost $6,000 for a $225 tax mistake (and still paying). When does it stop.

I have seen first hand the outrageous abuses that have occurred as a result of this organization. Brutallity beyond belief, suicides, homes taken from the elderly, just the most un-godly type of free reigning organization.

I am retired and I should not have much fear of the IRS but before I die, I will only be happy if America can rid itself of this terrible abusive agency. How can anyone consider himself free if he must undergo this terrible Nazi-like abuse? It is not necessary to go into the abuses on me by the IRS unless it will help the cause to erradicate this demon. I will definitly unleash my story if others are interested and will facilitate the fall of the IRS. I am not a Democrat nor really a Republican. I was actively interested in Forbes because of his Flat Tax in 1996; otherwise, he did not interest me much as a candidate.

I will do anything to help America purge itself of this nefarious outrage.

I am on a payment plan that will never be paid off. There was not enough taxes taken out during the year (it seems each year I change my withholdings to have more taken out and it is never enough)! I don't mind paying what I owe, but the penalty and interest are astronomical (what is the rate anyway?) If loan sharking is illegal, then why isn't what the IRS does illegal?

The IRS put a hold on our checking account twice this year because we defaulted on our installment agreement. For a family of four living from paycheck to paycheck, we were simply left without any money to use. Checks we have written bounced. Even when our account was negative and we had to borrow money to pay debts, the borrowed money was taken by IRS! The people running the IRS are ruthless and heartless. Congress must do something to curtail and control this ugly giant. This is a good time to ask for a flat tax with no loopholes.

I Purchase my business in 1985, at that time the business was using Independent Contractors. I kept going with the same setup.

In 1987 the IRS came in and said that they were going to do an audit to determine if the workers were employees or Independent contractors. At the end we received a letter from the agent stating that the company was in FULL COMPLIANCE.

In 1988 the Department of Labor came in to determine if the workers were employees or Independent contractors, when they looked at everything and talked to everyone they said they were satisfied.

In 1989 the ILLINOIS Department of Employment Security came in and said that they were going to do an audit to determine if the workers were employees or Independent contractors, at the end we received a letter stating that we were correct.

In 1995 the IRS came and said that they needed to do an audit, after this audit they said that the workers should have been employees and that we, the company, owes back taxes for payroll of $3,000,000.00 -- yes THREE MILLION DOLLARS

A. The IRS said they lost there records of the audit of 1987
B. The IRS said the other audits we had didn't have any bearing.
C. The IRS started collection and locked up my business
D. The IRS then said that I personally owed the $3,000,000.00

Since this started in 1995 The IRS has made my life a nightmare, and cost us hundreds of thousands of dollars.

In 1981 the bottom fell out of the oil field. I had worked in this industry for a number of years. Being a driller, I was responsible for providing transportation for myself and my crew. When starting with a new company it was common practice to take these travel expenses out of pocket until receiving the first payroll check and then a separate travel check to reimburse me for money spent. This check was tax exempt and did not require a 1099 to accompany my yearly return.

This practice worked fine until in 81 when a large number of drilling companies went bankrupt and filled this expense as taxable income in order to diffuse their liabilities. The IRS then began attacking the receivers of these checks, myself included. Going back to the very first year I received money of this type, adding penalties and interest and sending us a statement against money we didnt even know we owed . This continued for years, each year brought new penalties and interest on the next year and so on.

After quitting the oil field in hopes of putting a stop to this and getting a lesser job, paying what they said we owed, my hopes were shattered, they continued to hound us, year after year going back and refiguring and refiguring these returns and always finding yet another way that we owed more money. No one could help us, not only were they taking aprox. 1/3 of my pay in withholding on my payroll... we were destined to pay another 10-15% of my take home pay year after year without any sign of relief.

I have been unable to get out from under their scrutiny for 16 years now. I am now making close to half of what I was in 1981, and Im still subject to the wrath of the IRS.....

My family suffers as I cannot provide for them properly we have had many troubles due to our financial standing, cannot acquire credit, because we can never get ahead, and it has caused many personal problems as well within our household. And this continues even today, as we received yet another statement from the IRS says that we now owe 3,300+ dollars for 1988. Here it is 9 years later (can they do that????????).

Why can't something be done?? When the system can go back again and again over the same years and refigure and recalculate and deem that they want more and more money from the meek of this country!!

My family can starve and live on the street and they don't care, we have fought off levy after levy and attachments to my wages .... we have suffered over and over ... year after year ... we live each day from pay check to pay check ... with no end in sight .... The mental anguish, stress, and financial deprivation, the suffering they have caused. IN GOD WE TRUST, and someday GOD will deliver us from this hell we call the IRS !!!!

In 1990 I was treated so poorly by the IRS that I and my wife were in tears. It was a case of mistaken identity, something that should have been easily cleared up. They called me a liar on the telephone and refused to do the checking that would have cleared us.

On September 17, 1990 I received a notice of levy from my bank indicating that the IRS had taken our total checking account--$2397.46. We received notice, then, in an official notice of levy from the IRS, dated 9-16-90 that we owed them a total of $15,585.54.

We had no idea what this was all about. I was caught in an IRS snafu that accused me, as it turned out, of being another T. K. who lived in Florida. They had not an ounce of proof to back them up, nor, apparently, did they need any.

When I called the IRS, I told them that they had made a bad mistake. I was told by an extremely arrogant agent, "You don't fool us, Mr. K. We know you--we even talk to your neighbors." I told the agent, "I am sure you did not talk to our neighbors--I certainly wish you would.

I have been being harassed by the IRS for almost 2 years. They are auditing me for 92,93, and 95. They disallowed my children and my head of household status. It took over a year before they would acknowledge them. After that was settled, they decided that they would try and find something else to get me for. It's like a never ending battle. I am still trying to correct their errors. I have managed to hold off the various lien threats but this whole situation could have been totally avoided. They had no proof that my children weren't my children, yet they could manage to negate their existence for no reason. They can basically do whatever they want and get away with it. I'm glad that the IRS is finally being shown as the bully's that they are!!!!!

My husband and I were harassed and humiliated for a long period of time.

In December of 1991 I took early retirement. in 1993 when filing our tax return, we found out that we owed $17,000 dollars in taxes due to this early retirement. The IRS attached our checking and savings accounts without notifying us (the bank notified). We called to see how we could resolve this situation since we did not have the money to pay it in full. We were told to fill out numerous forms on our finances and send it in. We did so, and then called them. We were told that we could make monthly payments to pay this bill off. We were told an amount to pay and we agreed to do this. We asked for the person's name that we dealt with in case there were any problems but was told this could not be done. We then asked for a statement to be mailed to us showing this agreement so we would have something to refer to. Again we were told this could not be done. They said everything would be in the computer if there were any problems.

We made the payments and a few months passed and our checking accounts were attached again. We called the IRS to find out why and the person that answered said they were reviewing the files and decided to try to collect the money due. We explained the agreement we made with the IRS and we had to go through the whole scenario again. One clerk actually laughed at us after reviewing our income and the situation. We went through this several times and our nerves were shot because we never knew when they would attach our accounts again and cause us additional problems. We finally went to the bank and refinanced our house in order to pay off the debt which at that point was up to $23,000.

We were treated like criminals and felt totally defenseless in this whole situation. After all, who was going to protect us from our own government? My husband and I have always been behind our government 100% but after this situation occurred we realize how vulnerable we are and how little protection we have in defending ourselves from government agencies such as this.

Already thousands, if not tens of thousands of Americans live out their lives in fear of "big brother..." To learn the IRS is even able to intimidate members of juries sitting in judgment of IRS cases is chilling to every thought of justice! I also took note of the fact that one agent testified about a poor soul who became the focus of IRS attention for exercising his constitutional right to free speech! (writing a letter to the editor!) When will this stop?? Will it end only when the IRS begins putting us all into special "Tax Camps?" Once that happens, how long will it be before IRS agents are given the right to "liquidate" non-filers, or those who owe too much? Sounds ridiculous, I know... but the atrocities of Nazi Germany would have sounded pretty unlikely in 1933....

Only when the IRS is eliminated will America be free again. I don't oppose taxes, I oppose the oppressive and unconstitutional ways used by the IRS to punish those who dare to use their minds to think. In the 17th century one could be punished for "thinking about the death of the King.." Today, we learn, one can be punished for daring to think about the dismantling of the IRS

The IRS has damaged me and every other American citizen by forcing us to live in constant fear that one day there will be a knock at the door, or a letter in the mail demanding payment. Millions of American citizens live in constant fear of the IRS... The agency is guilty of, if nothing else, inflicting severe mental stress on honest, law-abiding citizens by conducting its campaign of terror and intimidation.

I owed them $4000, came up in audit .. was willing to pay as a result of the fear of going to jail .. had no real idea of what could happen .. was not aware that a lawyer could help

As a result I agreed to pay in full .. thought that I could pay off $4K in 2 years .. wrong!! penalties ands interest came to almost 200% of original .. still agreed to pay

Twice during the course of paying this off (5 years) I received letters threatening to seize my bank account due to non-payment .. I had been paying all along .. I had to contact the regional director in Denver to investigate (this after calling D.C. to find out what to do) .. turned out my payments went to someone else's account!!

I think the penalties and interest were way too high .. I did wrong but my total payout for $4K was close to $16K with all the interest!!

I felt threatened and abused but what could one do as the IRS carries a lot of weight and the little guy like me always pays up ..

My business and my family were badly damaged in 1985 by IRS agents. They foreclosed my business and it ended up costing me over $12,000 in interest, penalties, and loan fees to pay over next 5 years. We wish to recover some of the money due but couldn't afford the attorney fees.

In 1984 my business was doing well. Because I installed and repaired appliances and my wife was attending college we hired an accountant to see to the IRS quarterly payments, etc. I was signing checks to have the taxes sent and the accountant was not forwarding the money to the IRS. We got a notice in May of 1985 that we were in arrears with out quarterlies. This was the first we had heard of this and I immediately contacted the accountant who said we should "write to the IRS" and ask them about the letter, "it was surely a mistake." Before I had any word back two IRS agents appeared at my door and stated that they would be back at 0800 the next day and if we didn't "have $8,200 (approx.) he would "lock the doors and ruin the whole thing!" He came back next day with a locksmith to change the locks, drove by our home every few days and called our home to remind me that I was not allowed to function in my business. Other than

This harassment of me and my family we did not hear from the IRS for something over two months. It was at this time the agent informed me they would be taking bids on my business the next day. He received no bids and offered to "sell" the business back to us--I can't recall the sum--and finally ended up giving us the keys and set up a payment plan. We paid on this plan for a year and when I received no paperwork to confirm my payments I requested a summary. It was at that time we discovered that the payments were falling way short, the penalties and interest on what we owed were still accruing. We contacted the IRS office and were told Mr. G. was no longer there. The woman who met with my wife and me was very nice and was admittedly shocked by the plan set-up. She advised we secure a loan to pay the money off. Of course no one would give us a loan to pay off the IRS!

Through misunderstanding the tax laws, I failed to pay a portion of tax owed.. The assessment came to about $16,000. In accordance to a phone conversation with the IRS, it was agreed that I would pay $350 a month. I requested, but did not received, anything in writing from the IRS, such as a breakdown on the penalties and the payment agreement. After paying the $350 a month for eleven months, I received a notice from the IRS that I now owed close to $30,000. I ended up declaring bankruptcy and paying $600 a month for five years and a balloon payment of $6,000 at the end.

I commend you on your initiatives against these parasites of our society called the IRS. They have certainly destroyed everything I have worked for over forty years in just a couple of years. They have made my and my family 's life pure misery. They have contributed extensively to the destruction of my business and extensive family problems. The IRS be immediately dismantled and a national consumption tax is instituted instead. This can save this country and create another Switzerland. The IRS is worse than a bad nightmare that has plagued this nation for over forty years and is about to destroy it unless the IRS is eliminated and all its parasites are put to do something productive; like work!

I am presently going through hell with the IRS. I am continuously being lied to and when I complained to the supervisor the agents actions increased from bad to worse. I was born in Germany after the nazi years only to live them now.

I owed some back taxes. I tried to do an offer of compromise, but was told to withdraw it and borrow the money instead or they would make me pay $3500 a month. Our monthly income with 5 children is $ 4500. I was called continuously and threatened, I owe the back taxes, my husband paid all his. The IRS agent went to his work place and threatened him, while I was meeting with another agent from the same office!

One agent said they would turn over the financial information to the other agent to work out a monthly payment. I was waiting for this payment amount to be told to me. They then seized our total paychecks two days before the end of the month. Which left us no money for rent, food or child care. I have developed an ulcer, my blood pressure went from 120 over 70 to 199 over 97. I have lost over 35 lbs. and had to see a doctor for depression. I was a healthy well adjusted individual before the IRS became involved.

I want to pay the money I owe but they don't want to work on any payment plans. A tax year bill of $325 has became $2500. The IRS calls my office and announces it is the IRS calling, just to embarrass me. The IRS agent knew this would harm my husbands career as a financial manager, so she went after my husband and told me she would call his boss if I did not come up with the money. I did not have the money, if I did, I would not have to live through this hell.

By being honest and returning the refund of slightly over $400, I was charged more than $2000. I guess that shows you how much the IRS values honesty. I'm sure they had quite a few "yucks" around the office over this one.

My husband was self employed and did not pay the right amount of taxes. We were divorced some time later. My divorce decree designates my husband as the one that is suppose to pay the IRS. Because he has held a job only sporadically the IRS leaves him alone. I have all four kids and have held a job since the divorce. The IRS refuses to go after my x and keeps my income tax. I have four kids and am barely able to keep our heads afloat. I have shown my debt to income ratio and the IRS refuses to listen. They said there is no reason to settle this because they can continue to take my tax refund. How is this possible?? I am at my wits end. Can someone please get this bully off my back!?

Dear Sue:

Thank you for the reply to my email inquiry about the class-action lawsuit. I do consider myself a potential plaintiff in this case. Here's why:

In 1985, when I was an 19-year-old waitress, my employer failed to withhold enough from my wages. During some type of audit later, I (along with a few other employees) ended up having to repay the IRS a fairly small amount of money - around $117.00, I think. I did so promptly when I received a bill.

But several years later I was contacted by the Michigan automated collection system, with the IRS trying to collect this money from me again. I called them when I received the collection letter, explaining politely that they were mistaken and that I had settled this debt years ago.

I was informed that I had better produce some proof or pay up. I began receiveing letter after collection letter along with harrasing phone calls from collection agents who yelled at me and intimidated me - not to mention did not listen to what I was saying - I HAD ALREADY PAID. I ended up in tears, screaming at one of them to "never contact me again." I threatened to call a lawyer if the abuse did not stop. I also produced and mailed copies of the (by then several years old, by the way) cancelled checks that proved my innocence. Incidentally, I was informed several times that the records detailing this debt had long since been destroyed because of the age of the claim. All they had left was my name and a number that they felt I owed.

They stopped calling me, failed to acknowledge my efforts and WITHHELD this money erroneously from my next refund. I gave up contacting the automated collection system since no one there seemed to have a brain in their head. My tax preparer took over for me. He contacted state rep. Don Gilmer at that time and insisted that the abuse stop and my money be refunded. Lo and behold, it was refunded shortly afterward. I thought the problems were over.

Later that same year I began receiving collection letters AGAIN for this same amount. It was withheld in error a SECOND time from my refund. That was two years ago. Since then my tax preparer has had no luck getting my money back for me; he has been in contact with Don Gilmer again and again without results.

I contacted two attorneys who both advised me that it would cost more than it's worth to collect the money for me - they bill at $100.00 per hour and the debt isn't much more than that (although they did add "late" penalties!)

I sincerely hope you can help end this nightmare for me; I may not be one of those wealthy people who have lost hundreds of thousands to these creeps, but it is MY MONEY that they have stolen. I have a family of four living on a heavy equipment operator's salary. I lost my job last year and have more than my share of financial problems as a result. Even this small amount would be a tremendous relief to me.

I am a retired CPA, so nothing that I hear about the IRS and Congress's lack of control of this agency surprises me. However, why the American people in their complacency continue to put up with the complexities of and abuses from such a power-hungry, Congress-sponsored agency never ceases to amaze me.

Since retirement, any professional focus on my part in this area has been in supplying tax and financial planning services (gratus) to family members and surviving spouses of close friends. Having "removed my biased hat", I have really begun to realize just how far-reaching IRS abuses are and, even more importantly, that these abuses are primarily Congress-created and Congress-supported.

The IRS is only partly to blame. Congress, with the IRS following suit, has created the most complicated reporting and compliance system known in the history of the world, affecting some 265 million+ people in the US and millions more abroad. If members of Congress are indeed representatives of the people, then I can only paraphrase a well-known Biblical quote: "Forgive them Lord, for they know not what they do". Regrettably, they don't.

When Congress suggests changes, additions and deletions to the tax system, members, not having the experience and foresight, never realize just how complicated implementation of and compliance with their actions become. The IRS follows through with implementation and clearly believes that it has a mandate from Congress to force compliance.

Consequently, the changes are made, the IRS complies and the American people suffer. Shame on us for our complacency.

The IRS feeds on the lower-to-middle income taxpayer. These are the ones who in the main do not understand the tax system and for the most part cannot afford professional help. Seizure of assets, without due process, is common. A family's home can be seized with no prior notice and no hearing, and only requires the signature of an IRS District Director. No where else in our judicial system would that type of injustice be allowed.

When a system becomes so complicated for the masses that compliance can only be purchased from professionals, and only by those who can afford it, it is time for a change. The system, at a minimum, must be greatly simplified, due process and oversight must be required and atrocities eliminated.

More appropriately, it should be replaced, possibly with a much-simplified, consumer-based tax on spending. Do away with the IRS as we know it. Eliminate tax reporting. Divert our tax dollars to areas that are meaningful and stop paying for an agency that feels it has a mandate from Congress to simply do as it pleases.

Shame on us.

The IRS has no human soul. It is an agency made up of bureaucrats who neither know the person they are devastating, nor are they responsible to anyone for damage they have done. The net result is the alienation of citizens from their government.

After getting my bill from the IRS and knowing I have no way of paying except selling my home, I found your page. I feel suicide is the only answer. All I have left is my home and at 50 years old and on disability, I will be in the street. There is no future in this life for me. Reading others problems only makes me feel worse. Where can a person go for help?
